Agreement to Terms
By accessing or using InterGen's services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
Services
InterGen provides web development, hosting, managed support, and related technical services. The specific services provided to you will be outlined in your service agreement or statement of work.
Development Tools and AI
InterGen utilizes professional-grade development tools, including artificial intelligence, to assist in coding, optimization, and troubleshooting. By using our services, you acknowledge that portions of your website's code or database structure may be processed by these tools to resolve technical issues or enhance performance.
InterGen agrees to use AI vendors that provide contractual guarantees regarding data privacy and who do not use client data to train their public models. These include enterprise-grade services with appropriate data protection agreements in place.
For custom application development projects, any significant use of AI-assisted code generation will be disclosed in the project Scope of Work.
Confidentiality
InterGen will treat your business information, website code, and data as confidential. We will not disclose confidential information to third parties except:
- As necessary to provide services using trusted third-party tools and service providers (as described in our Privacy Policy)
- As required by law
- With your written consent
Confidential information may be processed by third-party tools used by InterGen for the purpose of service delivery, subject to the data privacy guarantees described above and in our Privacy Policy.
Acceptable Use Policy for Email Marketing Services
If you use InterGen's email marketing services, you agree not to send communications containing:
- Defamatory or libelous information or content
- Pornographic or adult content
- Illegal information or content that violates any laws
- Intellectual property infringements
- Viruses, malware, or hacking-related content
- Multi-level marketing or pyramid schemes
- Work-from-home schemes, gambling, or FOREX trading promotions
- List-selling or lead generation services
Email List Policy
Users of our email marketing services must ensure all recipients have explicitly agreed to receive mail from you. We recommend using Double Opt-In or Confirmed Opt-In methods, which require subscribers to take affirmative action (such as clicking a confirmation link) before their address is added to your mailing list.
Purchased, rented, or harvested email lists are strictly prohibited.
SMS Message Restrictions
If you use our SMS API services, the following are prohibited:
- Unsolicited messages or bulk marketing without consent
- Harassing, threatening, or abusive content
- Using SMS as a replacement for emergency services
- Fraud, phishing, or deceptive practices
- Adult or explicit content
Data Retention
Email marketing records on your account are stored for 35 days. After this period, records are automatically deleted.
For managed hosting clients, backup retention periods are specified in your service agreement.
Limitation of Liability
InterGen's liability for any claim arising from our services shall be limited to the amount paid by you for the specific service giving rise to the claim. InterGen shall not be liable for any indirect, incidental, special, or consequential damages.
Termination
Either party may terminate services in accordance with the terms of the applicable service agreement. Upon termination, you are responsible for retrieving your data before access is removed.
Changes to Terms
We may update these Terms and Conditions from time to time. Continued use of our services after changes are posted constitutes acceptance of the modified terms.
